Tell Missouri Lawmakers to Pass Legal System Abuse Reform Measures

It affects the economy, slows business growth, and puts jobs at risk. Two areas of legal system abuse that urgently need reform in Missouri are third-party litigation financing (SB 267/SB 268) and time-limited demands (HB 437/SB 312).
- Third Party Litigation Financing (SB 267 /SB 268): In 2023, lawmakers passed a bill to curb third party litigation financing, but it lacked critical transparency and disclosure reforms to truly protect consumers.
- Time Limited Demands (HB 437/SB 312): In 2017, lawmakers passed legislation attempting to reform the all-to-common practice of trial lawyers using time-limited demand settlements to extract settlements that far exceed policy limits. Unfortunately, trial lawyers have found a way around existing measures and are flooding Missouri courts with frivolous lawsuits, allowing them to line their pockets while likely increasing costs for Missourians.
Missouri residents pay a “tort tax” of almost $1,100 and more than 62,000 jobs are lost every year due to legal system abuse, according to a study by the Perryman Group. Without meaningful reform, the cycle of frivolous lawsuits and excessive court costs will continue to harm Missouri’s future.
Missouri’s lawmakers have made progress, but there’s still more work ahead. We need reforms to:
- Ensure transparency and accountability in third-party litigation financing to protect consumers (SB 267/SB 268).
- Close loopholes that allow untimed settlement demands that flood Missouri courts with frivolous lawsuits (HB 437/SB 312).
