The Missouri Legislature must VOTE YES on HB 437 and SB 312.
In 2017, lawmakers passed legislation to address settlement demands, but trial lawyers have exploited loopholes to continue abusing the system. Currently, trial lawyers are using settlement demands to extract settlements that far exceed policy limits, letting them line their own pockets while increasing costs for Missourians. These tactics force insurers into impossible decisions, leading to costly litigation that ultimately impacts Missouri consumers.
Already, settlement demands drive up the “tort tax”—hidden costs passed on to families and businesses. Currently, Missourians pay almost $1,100 a year in tort tax.
Now, trial lawyers are using “untimed demands”—settlement demands that do not include a time limit or deadline to respond—which allows them to avoid the statutory requirements put in place to reduce frivolous lawsuits and protect consumers.
Without stronger reforms, these unfair practices will continue to harm Missouri’s economy and communities. If passed, HB 437 and SB 312 would reform the current practice and help close this loophole.
