Legal system abuse grows when there is no transparency about who is funding a lawsuit or guardrails to protect everyday Americans from foreign investors looking to make a profit. Congress can bring some much-needed transparency to this shady, harmful practice.

Third-party litigation financing, also known as “litigation funding,” is a highly secretive practice that turns our courts into a money-making machine for unscrupulous lenders and foreign investors who are looking to control a lawsuit and maximize their rate of return, leading to increased litigation and higher court costs.

Continued legal system abuse, through practices such as litigation funding, drives up the costs of a range of products and services across the country. According to the U.S. Chamber of Commerce, the U.S. litigation system costs the economy $529 billion, an average of $4,207 in hidden legal costs per American household in 2022.

Right now, there are two House bills, H.R. 1109 and H.R. 2675, that aim to increase transparency in federal court cases and to limit foreign government and sovereign wealth fund involvement in U.S. lawsuits. If passed, these bills could help reduce incentives for litigation funders, protect consumers and small businesses, and help safeguard our courts and national security.
