The Problem

The Utah Legislature is considering passing SB 211, a bill that would overturn a key court decision (Gardner v. Norman). Since its ruling in 2025, medical damages in lawsuits are required to be based on the actual money paid for medical bills, rather than fictional list prices that no one ever pays.

Why It Matters

If this bill passes, it would allow “phantom damages”, or inflated costs, back into the legal system.
– Higher Prices: When legal costs go up artificially, it can lead to higher prices and higher premiums.
– Less Fairness: It would move Utah backward and into a market of made-up expenses and away from compensation based on real costs.
